These Terms of Use ("Terms") cover your use of the ProfPage website at profpage.com and the early-access list. ProfPage is a product of remarQable LLC ("remarQable", "we", "us" or "our").

By using the website, you agree to these Terms. If you do not agree, please don't use it.

1. Early access

If you join the early-access list, we will email you when ProfPage opens, plus occasional updates about ProfPage. You can unsubscribe at any time. Joining is free and does not create an account, a subscription or any obligation to pay.

If you tell us the page address you would like, we will try to hold it for you when accounts open, but we can't guarantee any particular address. We may decline addresses that are offensive, misleading, impersonate someone else or infringe someone's rights.

2. Plans, prices and features

ProfPage is not yet available. The features, plans and prices described on this website are our current plans, not promises. They may change, arrive later or not be released. Prices are in US dollars and do not include any taxes. Using ProfPage itself, once it opens, will be covered by separate terms that you will see before you sign up.

3. Example content

The example pages and sample profiles on this website, including "Dr. Elena Park" and "Riverton University", are fictional and shown for illustration only. Any resemblance to real people or institutions is coincidental.

4. Intellectual property

The ProfPage name, logo, website and its content belong to remarQable LLC and are protected by copyright and trademark law. All rights are reserved. You may not use the ProfPage name or logo in a way that suggests we endorse or are affiliated with you without our written consent.

5. Acceptable use

Please don't misuse the website: for example, by trying to break or overload it, gain unauthorized access, scrape it in bulk, or submit false, abusive or automated sign-ups to the early-access list.

6. Third-party services

The website uses services run by others, such as Google Fonts, Plausible Analytics and Formspree. We are not responsible for their content or practices, and their own terms and policies apply.

7. Disclaimer of warranties

The website is provided "as is" and "as available", without warranties of any kind, express or implied. To the fullest extent permitted by law, remarQable LLC disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

8. Limitation of liability

To the maximum extent permitted by law, remarQable LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of money, profits or data, arising out of or related to your use of the website or the early-access list.

Because the website and early-access list are free, our total liability for all claims related to them will not exceed one hundred US dollars ($100).

9. Indemnification

You agree to indemnify and hold harmless remarQable LLC and its officers, employees and agents from any claims, damages or expenses, including reasonable attorney fees, arising from your misuse of the website or your violation of these Terms.

10. Changes

We may update these Terms from time to time. We will post the new version on this page and change the effective date above. If you keep using the website after a change, you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Hennepin County, Minnesota.
